Terms of Service

The service

EcomSolveBD provides ecommerce attribution, server-side event delivery, ads reporting, order operations tools, and related analytics for merchants. Features may change as we improve the product. Beta features may be offered as-is.

Eligibility and accounts

You must be at least 18 years old and authorized to bind your business. You are responsible for accurate registration information, safeguarding credentials, and all activity under your account. Notify us immediately of unauthorized access.

Merchant responsibilities

You agree to:

• Comply with applicable laws, including privacy, marketing, and ecommerce regulations in your markets.
• Obtain valid consent before collecting or sharing end-customer data and before enabling tracking on your storefront.
• Configure integrations only for accounts and stores you own or are authorized to manage.
• Use platform APIs and event data in accordance with Meta, Google, TikTok, Shopify, and WooCommerce policies.

Data roles

For data about your customers and store visitors, you are the data controller (or business, under CCPA) and EcomSolveBD is the data processor, except where we act as an independent controller for account billing, security, and product analytics.

Subscriptions and billing

Paid plans renew according to your selected billing cycle unless cancelled. Fees are exclusive of taxes unless stated otherwise. Failure to pay may result in suspension. Refunds are governed by our Refund Policy.

Acceptable use

You must follow our Acceptable Use Policy. We may suspend or terminate accounts that violate Terms, abuse APIs, or create security risk.

Third-party services

Integrations with Meta, Google, TikTok, Shopify, WooCommerce, and couriers are subject to their terms. We are not responsible for third-party outages, policy changes, or account restrictions imposed by those platforms.

Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW. ATTRIBUTION AND ROAS METRICS ARE ESTIMATES; WE DO NOT GUARANTEE SPECIFIC ADVERTISING OUTCOMES.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ECOMSOLVEBD AND ITS SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE FEES YOU PAID IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

Indemnification

You will indemnify EcomSolveBD against claims arising from your store content, your violation of these Terms, or your misuse of customer data or ad platform policies.

Governing law

These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law rules, unless mandatory consumer protections in your jurisdiction require otherwise.
